Terms of Service

1. Who we are
Travelify ("Travelify," "we," "us") provides software that lets trip organizers ("Hosts") build branded websites and sell group trips, including bookings, deposits, and installment payments. Travelify is a software platform — not a travel agency, tour operator, or seller of travel. These Terms apply to Hosts and to the travelers who book through a Host's site ("Travelers"). You must be at least 18 to use the service.
2. Hosts are the sellers of record
The Host is the merchant and seller of record for every trip sold through their site. The Host is solely responsible for delivering the trip; setting and honoring pricing, cancellation, and refund policies; all customer service to Travelers; and obtaining any licenses or registrations required to sell travel in their jurisdiction (including state seller-of-travel registration where applicable). Travelify is not a party to, and takes no responsibility under, the contract between a Host and a Traveler.
3. The platform & our fees
Travelify provides the software only. We take no percentage of trip revenue — trip funds settle to the Host's connected Stripe account. Our own charges to Hosts, if any, are limited to subscription fees for the platform, described at sign-up. A Host may separately choose to pass Stripe's card-processing fee through to the Traveler, in which case the Traveler's displayed price includes that fee.
4. Payments & installment authorization
Payments are processed by Stripe, Inc. under the Stripe Connected Account Agreement (Hosts) and Stripe's terms (Travelers). Charges are made as destination charges to the Host's connected account. When a Traveler pays a deposit, they authorize Travelify and Stripe to store their payment method and to automatically charge it for the remaining scheduled installments on the dates shown in their payment plan, until the balance is paid. Travelers may update their saved card at any time from their payment page. Because Travelify uses destination charges, card-network chargebacks are initially borne by Travelify as the platform; Hosts remain responsible to Travelify for chargebacks, refunds, and disputes arising from their trips (see §9), and for all applicable taxes.
5. Cancellations & refunds
Each Host sets and is responsible for the cancellation and refund policy for their trips. When a Host cancels a booking, the Traveler is refunded in full and any remaining scheduled payments stop. Travelify currently absorbs Stripe's card-processing fee on refunds, so the Traveler is made whole and the Host is not charged that fee. Travelify does not decide whether a given trip is refundable — that is between the Traveler and the Host.
6. Traveler accounts & acceptable use
A Traveler's account is scoped to the individual Host whose trip they booked; Travelify provides the account and payment tools on the Host's behalf. You may not use Travelify to sell unlawful goods or services, to defraud Travelers, or in violation of any applicable law or the terms of our payment and infrastructure providers. We may suspend or terminate accounts that violate these Terms or that create risk for Travelers, Hosts, Travelify, or our partners.
7. Disclaimers
The service is provided "as is" without warranties of any kind. Travelify does not warrant that any trip will be delivered as described by a Host, and is not responsible for the acts or omissions of Hosts or Travelers.
8. Limitation of liability
To the maximum extent permitted by law, Travelify is not liable for indirect, incidental, or consequential damages, or for any trip not delivered as described by a Host. Our aggregate liability arising out of or relating to the service is limited to the greater of the fees you paid Travelify in the twelve months preceding the claim, or [USD $100 — confirm with counsel].
9. Indemnification
Each Host agrees to indemnify and hold Travelify harmless from claims, losses, refunds, chargebacks, and liabilities arising out of the Host's trips, their content, or their failure to deliver a trip as described, or otherwise arising from the Host's breach of these Terms.
10. Governing law & disputes

11. Changes
We may update these Terms; material changes will be posted here with an updated date. Continued use of the service constitutes acceptance.
